More Stakes Coming

They started March 26th in front of the city hall, with 3 ft tall yellow ribbon stakes marked “Temp Esmt” and in less than 2 weeks they’ve marked to Liberty. This marks the outer most boundaries of the temp take, outside these stakes, toward the home remains your private property during the project.

While technically no construction activity should occur outside the boundaries, there is a chance that they may encroach on your private property, if they do damage, they are obligated to fix it.  If they damage a tree it may not be possible to “fix” that.

There are 4 boundaries that matter.

  1. Perm Right of Way
  2. Limit of Pavement
  3. Construction Limit
  4. Temp Easement (temp take)

The Perm Right of Way (RoW) is measured from the centerline of the road and is typically 30 or 40 ft.  This includes the traffic lane (12 ft), the new bike lane (5 ft), the tree lawn (5 ft), and the sidewalk (5 ft).

The plan calls for a uniform tree lawn of 5 ft even where the right of way is larger.  Residents in the Woodbury subdivision of Bainbridge Rd have a 20 ft tree lawn.  There new tree lawn will only be 5 ft between the sidewalk and the new sidewalk will not be on the RoW line, so there will be a 10 ft area toward the home that will also be like a tree lawn.

The current plan calls for 21 ft of pavement beyond the current 12 ft lane white edge line.  Phase 1 includes a 3ft birm beyond the edge line (to be replaced by temp pavement) while Phase 2 doesn’t have much of a birm beyond the edge line.  A red ribbon stake marks the edge of temp pavement.  Beyond this is a temp drainage ditch that may extend to the white ribbon construction limit stake.

The Construction Limit is the boundary of the construction while the Temp Easement is a work area beyond the construction zone to allow workers to access the work area.  Items within the construction limit may be destroyed, on the south side by the temp drainage ditch, on the north side by the sidewalk.

The Temp Easement generally follows a straight line as the outermost (further from road, closest to home) except that at driveways the Temp Easement moves further toward the home so that the driveway can be adjusted (usually lowered) to meet the new profile of the road.  Its a matter of connecting the dots (stakes) to see where their limits are.  It will be helpful to review your OR Colan document.

So far on the South side the Temp Easement seems to be 2-5 ft beyond the Construction Limit (white stakes) except at the driveway where they can move in towards the home a small amount or a larger amount depending on the slope of the driveway relative to the road.

A pre-construction video was observed March 18, this was premature because the temp take (easement) was not staked.  It’s unclear if another, proper documentation will be done.  It is advisable that you take your own photos showing the condition of your property around the staked boundaries.

We can expect tree removal marking to occur after this temp easement marking is complete.
