Stakes Redefined

For quite sometime there has been an understanding of what the stakes mean as described in several posts under the tag RoW (Right of Way).  But there is a new player now (the contractor)  and we’re hearing a different story.

The old short white stakes (south side only) mark the “end of excavation/construction”, the tall yellow stakes mark the temp eminent domain take.  That’s not new.  What is new is that the contractor says that grading will occur UP TO the temp esmt tall yellow stakes.   This means that it isn’t an undisturbed area that is available to access the work area, it will in fact be graded (bull dozed) and replanted with seed.  Anything there or roots under that area will be damaged.

This is in direct conflict with the “no damage beyond the white stake” and it also contradicts the “construction zone vs temp esmt (take)” lines on the plans.

The only way to reconcile this is that “grading” is some follow up activity that isn’t considered “construction” and thus falls outside of  the :construction zone”.

So the prudent thing to consider now is that EVERYTHING beyond the yellow stakes can and likely will be damaged and that although there is no intent to go beyond the yellow stakes, mistakes happen!

Update: The city was unable to verify this new definition of the yellow stakes.  After reviewing the eminent domain documents it appears that they imply that grading will occur up to the temp esmt.  I will try to contact the county’s agent in an attempt to clarify this.
